JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 The petitioner is languishing in custody since 27.02.2015 in connection with Mirganj P.S. Case No. 116 of 2014 for the offences instituted under Section 366(A)/34 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that the sister of the informant, namely, Jahanara, left her house in the name to attend call for nature since then she is traceless. It has been alleged that the petitioner Brij Kumar had given mobile set to his daughter and he was always talking to her and also giving massage. It has further been alleged that one Truck driver has kidnapped his daughter with the help of his relative namely Afsana Khatoon. It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.26504 of 2015 (2) dt.28-07-2015 2/2 petitioner is in custody since 27.02.2015. It has further been submitted that the petitioner has falsely been implicated in the present case. It is further submitted that the petitioner may be released on bail after completion of eight months in custody i.e., from 27.02.2015.
On behalf of the State it has been submitted that the victim girl has been examined under Section 164 Cr. P.C. and the petitioner has been named by the victim.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of eight months in custody i.e., from 27.02.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, in connection with Mirganj P.S.
