The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 504, 376, 511 and 447 of the Indian Penal Code. It is alleged that the accused persons took the informant into wheat filed and made an attempt to ravish her when informant's mother and brother made protest then they were assaulted by the accused persons.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general and even assuming the accusation no offence under section 354 IPC is made out. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Patna High Court Cr.Misc. No.26339 of 2015 (2) dt.20-07-2015 2/2 The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Jandaha P.S. Case No.12 of 2015, pending before the learned Judicial Magistrate, 1st Class, Vaishali at Hajipur.
With the above observation, this application is, accordingly, disposed off.
