JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12.04.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Learned Addl. Sessions Judge II, Supaul vide letter no. 59 dated 28.3.2017 has reported that except one private witness, namely, Vishnu Kumar and the Investigating officer, Umesh Prasad, the then Officer-in-charge, Triveniganj police station, almost all prosecution witnesses have been examined. He further reported that to procure the attendance of the aforesaid witnesses, warrant of arrest has already been issued and information regarding compliance of the same has already been given to Superintendent of Police, Supaul. In view of the aforesaid report of Addl. Sessions Judge, Supaul, prayer for bail of the petitioner in connection with Session trial no. 155/2014 arising out of Triveniganj P.S. Case no. 97/2013 is, again, rejected.
However, Superintendent of Police, Supaul is, hereby, directed to ensure the presence of remaining prosecution witnesses of
Patna High Court Cr.Misc. No.35950 of 2016 (4) dt.12-04-2017 Session trial no. 155/2014 arising out of Triveniganj P.S. Case no. 97/2013 pending in the court of Addl. Sessions Judge II, Supaul/ concerned court within three months from the date of receipt/production of a copy of this order, failing which matter shall be viewed seriously.
Let a copy of this order be sent to Superintendent of Police, Supaul for needful.
