The present application has been filed for modification of the order dated 13.01.2017, passed in Cr. Misc. No. 1125 of 2017, in connection with Laheriasarai P.S. Case No. 416 of 2014, pending in the court of learned Chief Judicial Magistrate, Darbhanga, whereby the petitioner was granted provisional bail with a condition to deposit an amount of Rs. 85,000/- in the court below within a period of four months.

Learned counsel for the petitioner submits that due to ailment, the petitioner could not deposit the entire amount within the stipulated period. He has deposited only Rs. 10,000/-, out of

Patna High Court Cr.Misc. No.23108 of 2017 (2) dt.10-05-2017 2/2 Rs. 85,000/-. Learned counsel appearing for the petitioner seeks further four months' time for depositing the balance amount. Considering the aforesaid facts and circumstances of the case, the provisional bail granted to the petitioner vide order dated 13.01.2017 passed in Cr. Misc. No. 1125 of 2017 is extended for a further period of four months.

The order dated 13.01.2017 passed in Cr. Misc. No. 1125 of 2017 stands modified to the extent as indicated above. The modification application is, accordingly, disposed of.
