The petitioner seeks bail in a case for the offences punishable under sections 302 and 120 (B) of the I.P.C The prosecution story, in brief, is that on getting message by the informant on his mobile on 28.6.2014 that his daughter is seriously ill he reached at the village of his daughter and found corpse of her daughter was lying at the door and on asking from Samadhani she replied that some unknown persons assaulted her and seeing her serious condition she was brought to Sanjivini Hospital, Purnea where the doctor declared as dead. On behalf of the petitioner it has been submitted that the petitioner is in custody since 15.1.2015. Charge-sheet has been

On behalf of the State it has been submitted that name of the petitioner come in course of investigation. In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge 5th, Katihar in Sessions Trial No. 110 of 2015 arising out of Falka P.S. Case No. 159 of 2014.
