JUSTICE SUDHIR SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302 and 201/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons committed murder of son of the informant. It has been submitted on behalf of the petitioner that he is in custody since 18.3.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. From perusal of the F.I.R. it would appear that petitioner has been named merely on the basis of suspicion. From perusal of paras-8.9.10.

14 and 15 of the case diary it would appear that relating to death of deceased a separate case was instituted by the police and as per the said case the deceased had died in the encounter which had taken place between the police and the miscreants who were engaged in manufacturing of illegal arms. Petitioner has falsely been implicated in the present case.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Amrit Lal Yadav, learned Adhoc Addl. District and Sessions Judge, VIII, Munger, in connection with Sessions Case no. 999/1999 arising out of Mufassil P.S. Case no. 21 of 1999.
