JUSTICE SAMARENDRA PRATAP SINGH ORAL JUDGMENT Date: 23-09-2016 Heard learned counsel for the petitioner and the respondents.

2. The petitioner seeks payment of 10% pension and the entire gratuity with interest, which has not been paid to him, though he retired on 31.01.2009, as Jan Shiksha Padadhikari, Patna.

3. The petitioner submits that no proceeding is pending against him. He admits that he has been paid the other retiral benefits.

4. Having regard to the facts and circumstances of the case, it would be appropriate that the petitioner would file a detailed representation before the Director (Administration), Education

On receipt of such representation, the Director (Administration) Education Department (respondent no.3) would forth with dispose of the claim of the petitioner within two months and ensure payment of 10% of the pension and the balance of gratuity amount without any delay. The Director (Administration) Education Department would be also obliged at the same time to pass a speaking order on the representation of the petitioner.

5. With the aforesaid observation, the writ application stands disposed of.
