JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The case diary, as called for, has not been received as yet and submission on behalf of the petitioners is that petitioners were put on Test Identification Parade but witnesses failed to identify the petitioners which is evident from Annexure-2 series of supplementary affidavit. It is also pointed out on behalf of the petitioners that having more or less similar allegation, some coaccused have already been granted privilege of bail by this Court.
Patna High Court Cr.Misc. No.30160 of 2015 (3) dt.08-09-2015 2/2 No doubt, some ornaments are said to have been recovered from possession of petitioners but admittedly, the aforesaid seized articles were not put on Test Identification Parade. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram Town P.S. Case No. 453 of 2015.
