Having regard to the fact that the petitioner wants a direction from this Court for payment of family pension and that the respondents have already clarified that such family pension has already been sanctioned in the name of the petitioner and the petitioner was directed to furnish the bank account number in which payment could be made and the petitioner on 20.04.2015 has furnished the bank account number, this court would direct the concerned authorities to ensure that whatever arrears of family pension or current family pension

Patna High Court CWJC No.10358 of 2014 (2) dt.23-04-2015 is payable, must be paid in her bank account within a period of one month from the date of receipt of this order.

It goes without saying that other retirement benefits will abide by the result of the succession certificate to be obtained by the petitioner and other family members inasmuch as there still exists a dispute between the children of the first wife and the second wife and the petitioner being second wife was never entitled to get the family pension, this Court is not inclined to grant interest on the amount of arrears of family pension.

With the aforementioned observation and direction, this application is disposed of.
