JUSTICE SUDHIR SINGH ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420 and 409/34 of the Indian Penal Code.
The prosecution story, in brief, is that the petitioner and other c-accused has been allotted to complete the works of different schemes but they did not do the works allotted to them and thereby they committed criminal breach of trust and misappropriated the government money by withdrawing the same without doing the government work allotted them. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. As per
Patna High Court Cr.Misc. No.26828 of 2015 (3) dt.24-09-2015 2/2 allegation there is a short fall of Rs. 3 lacs approximately. It is further submitted that the petitioner is ready to deposit an amount of Rs. 25,000/- in the court below, which shall be subject to final disposal of the case.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 25,000/- in the court below, which shall be subject to final disposal of the case. Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K.Thakur, learned J.M., 1st Class, Banka in connection with Belhar P.S.Case No. 99 of 2014,G.R.No. 1159 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
