JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Piprakothi P.S. Case No. 25 of 2017 instituted for the offence under Sections-272, 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per written report, 24 bottles foreign liquor each containing 750 ml. kept under straw, have been recovered from Bamboo Clamp, situated in the back of house of the petitioner. The petitioner after seeing police party, fled away. The seizure list was accordingly prepared wherein it has been mentioned that foreign liquor has been recovered from Bamboo Clamp, situated in the back of house of the petitioner.

Therefore, this court is not inclined to grant

Patna High Court Cr.Misc. No.23096 of 2017 (2) dt.24-05-2017 2/2 anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

The petitioner is directed to surrender in the court below and seek regular bail, which will be considered and disposed off on the same day in accordance with law without being prejudiced by this order.
