The petitioner apprehends his arrest in connection with Mufassil (Lakho O.P.) P.S. Case No. 250 of 2016 registered under Sections 279 of the I.P.C. pending in the Court of C.J.M., Begusarai.
The accusation is that 20 to 25 cattle were found loaded in the vehicle. Out of which, some were found in injured condition. When the informant tried to stop the vehicle, the driver of the vehicle succeeded to flee away.
Learned counsel appearing on behalf of the petitioner submits that in fact, the cattle were purchased by the petitioner from the cattle fair and the same were being carried for selling in
Patna High Court Cr.Misc. No.33418 of 2016 (2) dt.26-08-2016 2/2 other cattle fair, but the Police apprehended the truck and truck driver.
Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, prayer or the petitioner for bail is rejected.
However, petitioner is directed to surrender before the Court below and pray for regular bail, which shall be decided on its own merit without being prejudiced by the present order. (Rajendra Kumar Mishra, J) Shail/- U T
