Petitioner seeks regular bail in connection with Phulparas P.S. Case No. 215 of 2018 (G.R. No. 1368 of 2018), registered for the offence punishable under Sections 447/341/323/324/325/307/379/504/34 of the Indian Penal Code. The allegation against the petitioner is that he assaulted the husband of the informant by means of iron rod, causing him grievous injuries.

Learned counsel for the petitioner submits that both the parties are co-villagers and there is land dispute in between them. Learned counsel further submits that altogether nine persons have been made accused and all accused persons are family members.

On the other hand, learned counsel appearing for the informant vehemently opposes the prayer for grant of regular bail and submits that petitioner has assaulted the husband of the

Patna High Court CR. MISC. No.53598 of 2019(3) dt.25-11-2019 2/2 informant, causing him grievous injuries on head (i.e. vital part of the body) and as such he does not deserve the privilege of regular bail.

Having heard learned counsel for the parties and taking into consideration the fact that both the parties are covillagers, there is land dispute in between them and petitioner is in custody since 22.06.2019, I am inclined to grant the privilege of regular bail to the petitioner.

Accordingly, let the petitioner Suresh Thakur @ Suresh Sharma be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Sri S. Kumar, learned Judicial Magistrate, Ist Class, Jhanjharpur, District - Madhubani in connection with Phulparas P.S. Case No. 215 of 2018 (G.R. No. 1368 of 2018).
