This application, for grant of anticipatory bail, arises out of Shahkund (Sajor) Police Station Case No. 168 of 2016, disclosing offences under Sections 147, 148, 149, 302, 323, 324, 504 and 506 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is land dispute between the parties and on account of that, altercation took place and a case and counter has been lodged by both the parties as both of them have sustained injuries. Hence, the petitioners deserve the privilege of anticipatory bail. Learned A.P.P. has opposed the prayer for bail of this petitioner and submitted that there is direct allegation of assault
Patna High Court Cr.Misc. No.22735 of 2017 (4) dt.13-07-2017 on the head of the husband of informant by a Khanti resultantly he died during course of treatment.
Considering the facts and circumstances of the case, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of this petitioner is rejected.
