2. The petitioner has preferred this application for grant of regular bail in connection with Mohanpur P.S. Case No. 94 of 2025 dated 16.03.2025 registered for the offences punishable u/ss 191(2), 191(3), 190, 329(4), 352, 351(3) and 103(1) of the B.N.S.
3. As per the prosecution case, on 15.03.2025, total 15 F.I.R. named accused persons incuding the petitioner armed with lathi-danda, axe, iron rod came at the door of the informant and started beating the door and lastly, they broke down the door and on hearing hulla, the informant's father opened the door then having seen the father of the informant, all the

Further, one Ajay Manjhi armed with axe assaulted on the informant's father on his head and neck due to which he got seriously injured and he fell down on the ground. Thereafter, the informant's father was taken to the hospital where he died during the course of treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner rather the specific allegation of assaulting the informant's father is against the co-accused, Ajay Manjhi. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.57106 of 2025(2) dt.25-08-2025 3/3 concerned, Sherghati, Gaya in connection with Mohanpur P.S. Case No. 94 of 2025, with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
