JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
There is specific allegation against the petitioner that he committed rape on the informant.
The submission on behalf of the petitioner is that the victim has already entered into compromise and no sign of rape was found in medical examination of the victim. It is further contended by him that the FIR was lodged after four days of the alleged occurrence and as a matter of fact, in course of investigation, not a single witness came forward to support the prosecution case.
Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to grant
Patna High Court Cr.Misc. No.27045 of 2015 (2) dt.29-07-2015 2/2 privilege of bail to the petitioner bail and accordingly, his prayer for bail in connection with Warisnagar P.S. Case No. 258 of 2014 stands rejected.
However, the concerned court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
