JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Darpa P.S. Case No. 21 of 2017 instituted for the offence under Sections 30(A) and 37(A)(B) of the Bihar Excise Prohibition Amendment Act, 20167.

As per written report, police received confidential information that this petitioner and accused Raj Kishsore Mukhiya are selling liquor in their home and they have kept liquor in huge quantity, the informant reached there and apprehended one person who disclosed his name as Aklu Mukhiya. Thereafter, the house of this petitioner was searched and 150 pieces of country made Nepali Saufi containing 300 ml. each kept in two plastic Sack (Bora) has been recovered. The seizure list has been prepared.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered and disposed off by the court below in accordance with law without being prejudiced by this order.
