Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 32(ii), (iii), 36, 41(i), (ii) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and allegation is of recovery of 4359.6 litres of liquor from a truck. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant, it is also submitted that petitioner is not the owner of the seized truck and he came to be implicated while he was passing from the place of occurrence and is in custody since 127-2024. It is next submitted at the cost of repetition that

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chhourahi (Chhaudahi) P.S. Case No. 84 of 2024.
