JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467,468,471 and 379/34 of the Indian Penal Code.
It is alleged by the Circle Inspector that the volume of rent receipts were found missing as it was stolen by some one. Subsequently, it was found that the petitioner came to deposit the rent on the basis of missing rent receipt. On the report of the Circle Officer and Halka Karmchari, show cause was issued to the petitioner wherein it was stated that the said receipt was given to the petitioner by co accused Ram Jeewan Singh. It is submitted by the learned counsel for the petitioner that petitioner is aged 97 years. Statement to the aforesaid effect has been made in paragraph 7 of the petition. Statement has also

Considering the nature of accusation and the old age of the petitioner, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Dalsinghsarai, Samastipur in connection with Dalsinghsarai P.S. Case No.133 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
