JUSTICE SUDHIR SINGH ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 201 and 34 of the Indian Penal Code and 27 of the Arms Act.
Allegation is that dead body of informant's husband had been found lying in water under the bridge and petitioner has been made accused on suspicion.
It has been submitted on behalf of the petitioner that he is in custody since 23.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Altogether five persons are named in F.I.R. including petitioner. Only suspicion has been raised against petitioner because of previous enmity. There is no substantive evidence to suggest his involvement in the present case.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
