The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.

As per prosecution, it is a case of commission of murder by the petitioner along with other accused. Learned counsel for the petitioners submits that after completing the investigation, the petitioners not sent up for trial and a final form has been submitted by the I.O. on considering the same, the court below took the cognizance vide order dated 27.07.2022 against the petitioners. No external injury were

Patna High Court CR. MISC. No.60865 of 2022(2) dt.08-02-2023 2/2 found. Doctor opined that cause of death was asphyxia due to drowning. Petitioners are languishing in judicial custody since 28.04.2022.

Learned APP appearing for the State has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Bidupur P.S. Case No. 199 of 2022, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
