2. The petitioner seeks bail in connection with Bhagwanpur P.S. Case No. 305 of 2023 registered for the offence punishable under Sections 8(c), 20(b)(ii)(b) and 29 of the NDPS Act.

3. As per the prosecution case, 12Kg 150 gram ganja has been recovered from the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in jail since 16.10.2023.

5. Considering the period of custody and the clean antecedent of the petitioner, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Additional Session Judge-cum-Special Judge-III, Kaimur at Bhabhua in connection with Bhagwanpur P.S. Case No. 305 of 2023.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Adhoura Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
