JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioners are in custody since 13.3.2015 in Buxar (T) P.S. Case No.118/15 for the offences under Sections 147, 148, 149, 341, 386, 379, 337, 323, 426, 307, 332, 353 and 427 of the I.P.C.
Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that the informant received an information on 11.3.2015 that a truck met with an accident with tempo and consequently the said truck dashed several persons in which some of them sustained fatal injuries and 3-4 persons died. People of mob protested and put the Generator, Almira and motorcycle on fire.
It is submitted on behalf of the petitioners that they
Patna High Court Cr.Misc. No.27121 of 2015 (2) dt.29-07-2015 2/2 are in custody since 13.3.2015 and charge sheet have been submitted. The case was instituted against 44 accused persons and other unknown 15 persons. Other co-accused persons have been granted bail vide Cr.Misc. No.24729/15.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of C.J.M., Buxar, in Buxar (T) P.S. Case no.118/15.
