JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 25(1-B) a, 26 of the Arms Act, 123 R.P. Act and 47(a), 57, 63 of Excise Act.
One country made rifle, Pressure Cooker, bottle of Indian made foreign liquor, one pouch of country made liquor and some pamphlets of candidate Akhilesh Kumar Singh were recovered from a room of a brick-kiln and in the said room, petitioner was found sleeping at the time of alleged recovery. The aforesaid brick-kiln belongs to Uma Shankar Singh and from perusal of the written report of the informant, it goes to show that the co-accused Akhilesh Kumar Singh was candidate in Panchayat
Patna High Court Cr.Misc. No.34040 of 2016 (2) dt.19-08-2016 2/2 election and he had stored the aforesaid seized articles. Petitioner does not have any criminal antecedent and is languishing in jail custody since long. Moreover, it is informed that co-accused Akhilesh Kumar Singh has already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court vide order dated 11.8.2016 passed in Cr. Misc. No.27682 of 2016. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Kaimur at Bhabua in connection with Bhabua P.S.
