JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2018 The petitioner is apprehending his arrest in connection with Dehri (T) P.S. Case No. 18 of 2018, registered for offences punishable under Sections 341, 342, 323, 324, 307/34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is that they intercepted the informant and assaulted him by knife.
Submission of learned counsel for the petitioner is that F.I.R. shows that there is general and omnibus allegation against all the accused persons and earlier a case has been lodged by the accused side against the informant and others case and as such the petitioner has falsely been implicated in this case. Heard learned A.P.P. as well as learned counsel for the
Patna High Court Cr.Misc. No.22969 of 2018 (5) dt.30-08-2018 2/2 informant, they have opposed the prayer for anticipatory bail of the petitioner by stating that in the restatement specific allegation is against the petitioner is of stabbing the informant. Having heard both sides, considering the facts and circumstances of the case as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and make prayer for regular bail, which would be considered on its own merit without being prejudiced by order of this Court.
Accordingly, this application is dismissed.
