JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 365 and 366(A) of the Indian Penal Code.

The statement of the victim has been recorded under section 164 of the Cr.P.C., in which, she stated that she was in relationship with the petitioner, since last two years and she left her home along with the petitioner and started living at Patna, from where, she as well as the petitioner were forcibly taken away by the brother of the petitioner. She further stated that the petitioner established physical relation with her, on false promise of marriage. The victim appears to be major as the informant

Patna High Court Cr.Misc. No.35424 of 2016 (3) dt.31-08-2016 2/2 disclosed her age as 19 years and the victim herself disclosed her age as 20 years.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya, in connection with Moffasil Case No. 215 of 2016.
