The petitioner seeks bail in a case instituted for the offences under Sections 420, 406, 120(B) and 34 of the Indian Penal Code.

The prosecution case in short is that the accused person by impersonating him as Sales Manager misappropriated a sum of Rs. Four lakhs from the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.6.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The matter relates to

Patna High Court CR. MISC. No.55888 of 2019(2) dt.05-09-2019 2/2 business dispute. The account in which the informant had deposited the money does not belong to the petitioner. The same is in the name of Hindustan Agro Industries Ltd. Who has not supplied the goods to the informant. The petitioner is simply a Sales Man of the said Company.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhubani in connection with Jainagar P.S. Case No. 696 of 2018 C.R.I. Case No. 2505 of 2018. (Sudhir Singh, J) Pankaj/- U T
