The petitioner is languishing in custody in a case registered for the offences punishable under Sections 394, 397 of the Indian Penal Code.

It is alleged that three persons riding on a motorcycle tried to snatched the bag containing cash from the informant and when the informant made protest, one person fired from his pistol which hit on the thigh of the informant and thereafter they took away the

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner was not apprehended from the spot and his name surfaced on the confessional statement of co-accused Sonu Kumar. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has still not been put on T.I.P. The petitioner is languishing in custody since 20.02.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the fact aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Rampur P.S. Case No.
