JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 28.09.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

The learned trial court has reported that out of nine proposed prosecution witnesses, six have already been examined and only three prosecution witnesses including I.O have been left to be examined. Trial court has assured that trial of the petitioner is likely to be concluded by last opening week of December, 2016. In view of the aforesaid report as well as submissions of the parties, I am not inclined to release the petitioner on bail and his prayer for bail in connection with Sessions trial no. 86/2016 corresponding to Dehri (T) P.S. case no.502/2015 is again rejected. However, Addl. Sessions Judge VII, Rohtas at Sasaram/ concerned court must take serious efforts to conclude the trial of the petitioner within the period as fixed by the learned trial court itself.
