====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 06-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Forbesganj (Fulkaha) P.S. Case No. 141 of 2020 dated 19.11.2020 registered for the offences punishable under Sections 354B, 354C, 354D of the Indian Penal Code, Sections 7/8 of the Prevention of Children from Sexual Offences Act and Sections 3(i)(r(s) of the SC/ST Act.

3. As per the prosecution case, the petitioner and the co-accused person tried to kidnap the informant for the purpose of the marriage. On hulla, they started outraging her modesty.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.63057 of 2023(2) dt.06-10-2023 2/2 that the petitioner is innocent and has falsely been implicated in this case. No offence under SC/ST Act is made out against the petitioner. The petitioner has been made accused in the present case due to previous enmity and village politics. Other coaccused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 14043 of 2023 under order dated 17.05.2023. The petitioner has clean antecedent and he is in jail custody since 05.06.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Araria, in connection with Forbesganj (Fulkaha) P.S. Case No. 141 of 2020.

7. The application stands allowed.
