2. The petitioners apprehend their arrest in a case registered for the offence under Sections 406, 408, 409 of the Indian Penal Code.

3. It is alleged that these petitioners in connivance with the then Mukhiya of Gram Panchayat "Chhitahi Hanuman Nagar" misappropriated government money without completion of the work under the "Mukhyamantri Gali Pakki karan Nischay Yojana".

4. Learned counsel for the petitioners submits that pursuant to the direction passed by the Panchayat Secretary

Patna High Court CR. MISC. No.58866 of 2025(2) dt.09-09-2025 2/2 dated 17.10.2022, petitioners have already deposited Rs. 11,57,600/- in the account of concerned Gram Panchayat on 12.03.2024, 28.02.2024, 08.05.2025 and 09.05.2025 (copy of receipts of money are annexed as Annexure - 2 series to the bail petition). Petitioners claim clean antecedent.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the fact that the alleged misappropriated amount has already been deposited by the petitioners and petitioners have clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Bhaptiyahi P.S. Case No. 120 of 2023, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
