The petitioner seeks bail in a case instituted under Sections 364, 302, 201 and 120(B)/34 of the Indian Penal Code. The prosecution story, in brief, is that the father of the informant went with two unknown persons and thereafter the informant tried to contact his father on his mobile but the mobile was found switched off. The informant apprehends that the F.I.R named accused persons have abducted his father due to some ulterior motive.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.01.2016. The charge sheet has been submitted in the present case. The petitioner has got no

Patna High Court Cr.Misc. No.36260 of 2016 (3) dt.25-10-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. His name has come on the basis of confessional statement of co-accused. The other coaccused has been granted bail vide Cr. Misc. No. 25112 of 2016. On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Bodh Gaya P.S.
