Petitioners seek bail in a case registered under sections 395 and 379 of the Indian Penal Code. It is alleged that while the informant was sleeping in his house on 14-15.12.2014 all of sudden at about 330 A.M. upon hearing the sound of knocking his door he awoke. As soon as the informant opened his door four five persons armed with country made pistol, knife and club etc. entered the informant room and on the point of arms asked the key of Armirah and also asked to open the same. It is alleged that Rs. 2 lakh in cash and golden chain, golden rings tops and other silver ornaments worth
Patna High Court Cr.Misc. No.27473 of 2015 (2) dt.31-07-2015 2/2 Rs. 2 lakhs has been looted by the miscreants. It is submitted that the petitioner is in custody since 28.01.2015 and charge sheet in the case has been submitted. Petitioner is not named in the first information report. There is no recovery of any incriminating article from his possession. The petitioner has not been put on T.I.P.
It is submitted on behalf of the State that petitioner's name has come during the course of investigation. Considering the aforesaid facts, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 793 of 2014.
