The petitioners, namely, Jogi Mahto and Fucho Mahto, apprehend their arrest in Balia P.S. Case No. 386/15 registered under Sections 406, 420, 375/34 of the Indian Penal Code.
The informant alleged that the petitioners came to his field and demanded extortion of rupees two lacs fifty thousand. On refusal, the petitioners assaulted the informant with fists and slaps and snatched Rs. 20,000/- from the possession of the informant. Mr. Ansul, learned advocate for the petitioners submits that all the allegations are false and concocted. The informant was ploughing his field and snatching of Rs. 20,000/- from the possession of the informant, that too, in the field
Patna High Court Cr.Misc. No.34543 of 2016 (3) dt.03-10-2016 2/2 appears to be a concocted story. There was some dispute for payment of dues and that is why the informant lodged this false case. During the course of investigation, the witnesses have also stated the same fact that on account of payment of some dues, this false case has been filed. Learned A.P.P. did not dispute this fact. Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Balia P.S. Case No. 386/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
