JUSTICE MADHURESH PRASAD ORAL ORDER 01-06-2017 Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in Hathauri P. S. Case No. 8 of 2017 registered for the offences under Sections 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code.
As per the written report, on 16.01.2017 at 10 A.M., Anuj Kumar Singh was constructing illegal structure on the land of the informant and when the informant protested, it is alleged that Anuj Kumar Singh, Monu Singh along with Manju Devi abused the informant and assaulted with lathi and danda on his head.
It is submitted on behalf of the petitioner the
Patna High Court Cr.Misc. No.24391 of 2017 (2) dt.01-06-2017 2/2 petitioner is innocent and he has not committed any offence. Further submission is that there is a bona fide land dispute between the parties. It is also submitted that in respect of the same allegation, F.I.R. has been lodged by the mother of the instant petitioner bearing Hathauri P.S. Case No. 7 of 2017 in which the informant of the instant case is also an accused. Further submission is that Co-accused Monu Singh and Manju Devi have been granted bail by this Hon'ble court in Cr. Misc. No. 16062 of 2017.
In view of the aforesaid submission, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Rosera, Samastipur in Hathauri P. S. Case No. 8 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
