The petitioners are apprehending arrest in a case registered for the offences punishable under sections 363 and 366/34 of the Indian Penal Code.
It is alleged that co-accused Amit Kumar Yadav kidnapped the minor daughter of the informant. When the informant went to the petitioners being the father, brother and uncle of Amit Kumar Yadav, they drove the informant out of the house.
It is submitted by the learned counsel for the petitioners that the accusation is against Amit Kumar Yadav and
Patna High Court Cr.Misc. No.27617 of 2015 (2) dt.22-07-2015 the petitioners have been simply roped in since they happened to be the family members of the main accused. The petitioners have got no criminal antecedent.
Considering the abovementioned facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar III, Judicial Magistrate, 1st Class, Katihar in connection with Falka (Pothia) P.S. Case No. 71 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Dinesh Kumar Singh, J) Amin/- U
