The petitioner is in custody in a case registered under Section 376 of the Indian Penal Code.

The allegation against the petitioner is of committing rape with the informant/victim since last five months on promise to marry with her.

On behalf of the petitioner, it has been submitted that the petitioner is in custody since 5.5.2015. The petitioner has no criminal antecedent. From prosecution case, it appears that it was a consented physical relationship between the parties on pretext of marriage. Subsequently the marriage was not accepted on the part of the petitioner. Patna High Court Cr.Misc. No.27560 of 2015 (2) dt.31-07-2015 2/2 been brought against him. Further it is submitted that there was no such promise made on behalf of the petitioner in respect to the marriage nor he has established any physical relationship with the informant.

On behalf of the State and the informant, it is submitted that the petitioner is named in the FIR and there is specific allegation against him and charge sheet ahs been submitted in this case.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Katihar in Azamnagar P.S.Case No. 51/2015.
