JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rajepur P.S. Case No. 66 of 2019, registered for the offences punishable under Sections 272, 273 of the Indian Penal Code Section 30 (a) of the Bihar Excise Prohibition Act, 2016.

Allegation is of recovery of 10 liters of country made liquor was recovered from the house of the petitioner. Submission of the learned counsel for the petitioner is that house from where the recovery was made does not belong to the petitioner and he has no criminal antecedent and he has been falsely implicated in this case.

Learned A.P.P. for the State has opposed the prayer of bail on the ground of maintainability.

Having heard both sides. In view of the allegation, I

No.54601 of 2019(2) dt.30-08-2019 2/2 am not inclined to grant privilege of anticipatory bail to petitioner, however, he is directed to surrender before the learned Court below and make prayer for regular bail and Court below will consider the matter on its own merit without being prejudiced by order of this court, if possibly be disposed of at the same day.
