13-07-2017 Heard Sri Kamlendra Prasad Singh, learned counsel for the petitioner and Sri Ashok Kumar, learned Addl. Public Prosecutor.

The sole petitioner, who is owner of a pick-up van, has approached this Court with a prayer to extend the privilege of anticipatory bail in Deo P.S. Case No. 19 of 2017 registered for offence under Section 30(gh) of the Bihar Prohibition and Excise Act, 2016.

It was submitted by learned counsel for the petitioner that the petitioner is the owner of small industry dealing with the grain and his vehicle was illegally used by the driver and vehicle was intercepted loaded with Mahua flowers in 25 bags. He submits that save and except showing the petitioner as a registered

Patna High Court Cr.Misc. No.24864 of 2017 (2) dt.13-07-2017 2/2 owner of the vehicle, there is no other material to connect the petitioner.

Considering the fact that petitioner is the owner of the vehicle and there is no other further material, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Vijay Sao @ Vijay Kumar Sao be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge IV cum Special Judge, Aurangabad in connection with Deo P.S. Case No. 19 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure, 1973.
