JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 Petitioners apprehend their arrest in connection with Bhagwanpur (Belaon) P.S.Case No. 21 of 2018 registered for the offences punishable under Sections 144, 149, 379, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners is that they have cut the paddy crop from the land of the informant and taken away. Submission of learned counsel for the petitioners is that the land is purchased land of the petitioners and there is inordinate delay in lodging the FIR and with respect to the land Second Appeal is pending.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail stating
Patna High Court Cr.Misc. No.24505 of 2018 (4) dt.22-06-2018 2/2 that informant had nothing to do with the Second Appeal pending before this Court as she has purchased the land. Having heard both sides and in the facts and circumstances, as stated above, let petitioners, above named, surrender within a period of six weeks from the receipt of this order and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Satya Prakash, A.C.J.M.-IV, Kaimur at Bhabua, in connection with Bhagwanpur (Belaon) P.S.case No. 21 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioners will not threat the informant and other family members and not tampering with the evidence.
