1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(2), 109(2) and 3(5) of the BNS, 2023.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and in sum and substance, the allegation in the FIR Ladle along with Jabbar and Rahim snatched the motorcycle of the informant and thereafter on instruction of Abid Hussain, petitioner, Jabbar and Rahim inflicted sword and knife blow on the chest of the informant and his friend Anish Roy with an intention to kill them, further Anish Roy got injured in the occurrence.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.56895 of 2025(3) dt.07-11-2025 2/2 Abdul Jabbar @ Jabbar had moved this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 41542 of 2025 and the same was allowed by an order dated 09.07.2025 by a learned Co-ordinate Bench of this Court. It is next submitted that case of the petitioner is on a similar footing.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pothia P.S. Case No. 57 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.
