This application for anticipatory bail arises out of Mashrakh P.S. Case No. 110 of 2016 for the offence punishable under Sections 341, 188, 353, 504 and 506/34 of the Indian Penal Code.

Assistant Sub Inspector of Police of Mashrakh Police Station is the informant. It is evident from the First Information Report that there was some dispute in respect of possession and title over a piece of land between one Krishna Mahto and the petitioner and others. The police party had gone there to conduct an enquiry. When they noticed some scuffle between the two parties, they attempted to pacify, whereafter, allegedly, the persons, named in the First Information Report, misbehaved with the police party.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.54067 of 2019(2) dt.30-08-2019 2/2 petitioner appears to be correct in his submission that there is vague allegation of misbehaviour in the First Information Report.

Considering the above submission, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Saran at Chapra, in Mashrakh P.S. Case No. 110 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
