The petitioners being the Junior Engineer and Technical Assistant are apprehending their arrest in a case registered for the offences punishable under Sections 406, 409, 467, 468, 408, 465, 466, 471 and 120B of the Indian Penal Code.

The prosecution case is that the Panchayat Mukhiya, Panchayat Secretary, Junior Engineer and others misappropriated Rs, 9,67,200/- under the MANREGA Scheme No. 1 of 2012-13 and other schemes. It is submitted by the learned counsel for the petitioners that the thrust of accusation is against Panchayat

Patna High Court Cr.Misc. No.28976 of 2015 (2) dt.27-07-2015 Mukhiya and Panchayat Secretary, who were executing agency and during enquiry it was found that Rs. 59184/- was only misappropriated. The Panchayat Rojgar Sevak Jagdish Kumar has already deposited the alleged amount of Rs. 59184/- and considering the same the Panchayat Rozgar Sevak and Panchayat Mukhiya have been granted bail vide Cr. Misc. No. 14329 of 2015 and 23542 of 2014.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Harlakhi P.S. Case No. 46 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
