The petitioner apprehends his arrest in Rajauli P.S. Case No.229 of 2019 registered under Sections 406, 420, 467, 468 and 471 of the Indian Penal Code.

The Block Supply Officer, Rajauli lodged the case alleging therein that the petitioner with his application, to get license of P.D.S. shop, submitted forged marksheet of graduation and on inquiry, it transpired that the graduation marksheet was not issued from Magadh University, Bodhgaya. The learned counsel for the petitioner submits that license of the petitioner has already been cancelled. Petitioner is simply matriculate and he has passed computer examination. The petitioner himself did not submit the application form and he has no knowledge about the submission of forged certificate

Patna High Court CR. MISC. No.55731 of 2019(2) dt.05-09-2019 2/2 along with the application of the petitioner. It appears from perusal of the record that the petitioner appeared before the selection committee and the selection committee took computer examination of the petitioner and on his performance he was selected for grant of license but it transpired later on that the petitioner submitted forged marksheet of graduation.

Taking into consideration the fact that license has already been cancelled and the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No.229 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
