Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with S.T. Case no 132/2020 arisen out of Leheriasarai P.S. Case No. 294 of 2020 lodged under Sections 302, 201, 34 of the I.P.C. As per the prosecution case, the F.I.R. has been lodged against 2 named accused persons. As per the F.I.R., the entire allegation is against accused no.1 and nothing specific against the present petitioner.

Learned counsel for the petitioner submits that the story has been narrated by the informant and from the said story, it is crystal clear that the entire action or non-action has been

Patna High Court CR. MISC. No.56636 of 2022(2) dt.21-02-2023 2/2 done by accused Md. Riyaz @ Surya and not by petitioner. Counsel submits that antecedent of the petitioner is clean and he is in custody since 21.06.2020.

Upon specific query whether charge has been framed or not, counsel submits that from the order sheet, it transpires that charge has already been framed on 22.01.2021 in this case. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, Darbhanga in connection with S.T. Case no 132/2020 arisen out of Leheriasarai P.S. Case No. 294 of 2020 , subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
