The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 447, 341, 323, 324, 307, 379, 504, 506/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the accused persons including the petitioner came to the shop of the informant and started abusing and demanded Rs. Two lacs by way of extortion and when the informant protested, it is alleged that this petitioner assaulted him by sword on his head causing injury and thereafter, other named accused persons assaulted his uncle and brother. It is next alleged that uncle suffered grievous injury.
The learned counsel for the petitioner submits that the petitioner is alleged to have assaulted the informant. There is no
Patna High Court CR. MISC. No.68432 of 2021(3) dt.25-07-2022 2/2 allegation of assault by this petitioner to the uncle and son of the informant. It is next submitted that the injury suffered by the informant is simple in nature and that too, caused by hard and blunt substance when the allegation in the F.I.R. is of assault by sword which gets negated by the injury report. The learned Additional Public Prosecutor opposes the anticipatory bail application.
Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jamo Bazar P. S. Case No.260 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
