2. The accused/petitioner seeks bail in connection with Ara Nagar P.S. Case No.657 of 2024 registered for the offences punishable under Sections 126(5), 127(2), 308(4), 308(5), 111, 61(2) of the Bhartiya Nyaya Sanhita (for short 'B.N.S.') and Section 27 of the Arms Act.
3. The accused/petitioner is named in the FIR and is in custody since 08.01.2025.
4. Allegation against the petitioner is to extort money from informant repeatedly along with other coaccused persons upon instruction of Belal Miyan.
5. It is submitted by learned counsel appearing for
Patna High Court CR. MISC. No.60665 of 2025(2) dt.15-10-2025 2/3 petitioner that with same allegation co-accused Md. Shanwaj @ Md. Sahnwaj was granted anticipatory bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No.31225 of 2025 dated 28.07.2025. It is pointed out that the thrust of allegation is available against co-accused Belal Miyan and the petitioner is implicated in this case with general and omnibus allegation, as he came to the place of occurrence on call of co-accused Belal Miyan. It is submitted that in fact a false case raised in the background of land dispute and the amount as alleged was paid in that connection otherwise paying regularly on demand in itself a doubt qua allegation of extortion money. While concluding argument, it is submitted that investigation of this case is already completed, for which, charge-sheet has already submitted and, as such, there is no chance of tampering with the evidence and moreover the petitioner is a man of clean antecedent.
6. Learned APP opposed the prayer for grant of bail to the petitioner.
7. In view of aforesaid factual submissions and by taking note of fact as petitioner facing general and omnibus

No.60665 of 2025(2) dt.15-10-2025 3/3 allegation, where the thrust of allegation is available against co-accused Belal Miyan, coupled with the fact that other coaccused persons were granted anticipatory bail by one of the learned co-ordinate Bench of this Court, as discussed aforesaid, where petitioner remains in custody since 08.01.2025, accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara in connection with Ara Nagar P.S. Case No.657 of 2024, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
