Petitioner happens to be the husband of the deceased and there is allegation against the petitioner that he as well as his other family members used to demand illegal dowry and also put the deceased into cruelty. It is alleged that subsequently deceased was done to death by petitioner and his other family members.
The dead body of deceased has not been recovered and it is obvious from the materials available on record that the dead body of the deceased was disposed of by her in-laws including the petitioner without giving any information to the informant regarding the death of the deceased. Therefore, taking entire facts and circumstances of the case, I do not think it proper
Patna High Court Cr.Misc. No.36324 of 2016 (3) dt.25-10-2016 2/2 to release the above named petitioner on bail. Accordingly, his prayer for bail in connection with Tekari P.S.Case No.91 of 2015 pending in the Court of CJM, Gaya stands rejected. However, if the case is still pending in the Court of CJM, Gaya/concerned Court, the CJM, Gaya/concerned Court must commit the case of the petitioner to the Court of Sessions in accordance with law within three weeks from the date of receipt/production of a copy of this order and after commitment, the concerned Sessions Court should expedite the trial of the petitioner and try to conclude the same as early as possible.
