JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-07-2017 Heard learned counsel for the petitioner and learned senior counsel appearing on behalf of the opposite party no.2. This application, for grant of anticipatory bail, arises out of Complaint Case No.28582(C) of 2014, disclosing offences under Sections 406 and 420 of the Indian Penal Code and Section 138 of the N.I. Act.
The petitioner is alleged to have issued the cheques, which stood dishonoured for insufficiency of fund. The petitioner has been implicated on the ground that the account against which the cheques have been issued is joint account of the petitioner and his son, who has issued the cheques.
Patna High Court Cr.Misc. No.23633 of 2017 (3) dt.21-07-2017 Considering the submission that the petitioner is not the author of the cheques in question, this application for anticipatory bail is allowed.
Let the petitioner, Pankaj Kumar Khatri, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna, in connection with Complaint Case No.28582(C) of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
