JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2018 Petitioner apprehends his arrest in connection with Kankarbagh P.S.Case No. 22 of 2018 registered for the offences punishable under Sections 498A, 323, 325, 504, 506 and 342/34 of the Indian Penal Code.

Allegation against the petitioner is that he has subjected his wife to cruelty and torture.

Submission of learned counsel for the petitioner is that marriage was solemnized 25 years ago with the informant and and out of their wed log three children were born and he has purchased a house in the name of his wife, the informant. However, in the influence of mother-in-law, the informant is not ready to keep his father and mother with the petitioner and for that dispute arose

Patna High Court Cr.Misc. No.22974 of 2018 (5) dt.26-06-2018 2/3 leading to altercation. Further submission is that a case has also been lodged by mother of the petitioner. However, petitioner is ready to keep his wife with him at present.

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail of the petitioner stating that situation has come to that point that it is very difficult for them to live together and informant has also filed a petition for divorce before the family court but the petitioner is not appearing in that case.

Having heard both sides and considering the fact that marriage was solemnized 25 years back and they have children also, the petitioner is directed to surrender within a period of six weeks from the receipt of this order and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna, in connection with Kankarbagh P.S.Case No. 22 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to appear before the
